Abstract
Das Vergaberechtsmodernisierungsgesetz (VergRModG) soll das Richtlinienpaket zur Modernisierung des Vergaberechts (2014/23-25/EU) bis zum 18. April 2016 in nationales Recht umsetzen. Das Vergaberechtsmodernisierungsgesetz sieht mit § 131 GWB-Entwurf eine Regelung zum Verhältnis zwischen dem allgemeinen Vergaberecht und der VO 1370/2007 im Bereich der Eisenbahnen vor. Der Entwurf der Bundesregierung geht dabei über die Vorgaben der Vergaberichtlinien hinaus. Vor diesem Hintergrund beantwortet der Beitrag die Frage, welche Direktvergabetatbestände der VO 1370 auch künftig im Eisenbahnbereich zulässig sein werden und an welcher Stelle der Gesetzgeber nacharbeiten sollte.
The Act to Modernize the Law of Procurement (VergRModG) shall implement the set of directives to modernize the Law of Procurement (2014/23-25/EU) in its national law until 18 April 2016. By the transitional provisions of § 131 GWB (Act against Restraints of Competition), the Act to Modernize the Law of Procurement is to provide a regulation of the relation between general procurement law and direct awarding as required by VO 1370/2007 in the area of railway undertakings. The Federal Government's draft Act is about more than the requirements of the procurement directives. Against this background, this article gives answer to the question, which facts of direct awarding as required by VO 1370 will still be allowed in the future and which part should be revised by the legislator.
