Vergabefreie Subventionen im ÖPNV. Anmerkung zum Beschluss des OLG Karlsruhe vom 13. Juli 2005.

Abstract

Der Autor kommentiert den Beschluss des OLG Karlsruhe vom 13. Juli 2005 zur Vergabefreiheit öffentlicher Zuschüsse zur Gewährleistung einer bestimmten Qualität im ÖPNV. Dieser stellt klar, dass die Umsetzung des EuGH-Urteils Altmark Trans zur beihilferechtlich zulässigen Bezuschussung des Nahverkehrs ohne Ausschreibungsverfahren nicht prinzipiell an den Vorgaben des allgemeinen Vergaberechts scheitern muss. Damit gewinnen die Aufgabenträger die notwendige Zeit und die Handlungsinstrumente, die für einen geordneten Übergang des ÖPNV in den Wettbewerb auf Grundlage von Linienbündeln notwendig sind. difuThe author comments on the decision of the provincial high court and court of appeal (OLG) Karlsruhe, dated 13th July 2005, referring to the free allocation of public subsidies in order to grant a defined quality level in the short distance traffic. The decision straightens out that the implementing of the judgement of the European Court of Justice, Altmark Trans which allows legal subsidies for short distance traffic without invitation of tender, shall not fail because of the requirements of the general bidding procedures. Therewith, the customers may gain time and get the necessary means of trading which are necessary for a correct transition of the passenger transport to competition. difu
