SPNV-Direktvergaben unzulässig? Nach Entscheidung des OLG Düsseldorf hat nun der Bundesgerichtshof das letzte Wort.

Abstract
Das OLG Düsseldorf hält Direktvergaben im SPNV für unzulässig. Dies gilt insbesondere für solche, die nach § 15 Abs. 2 AEG realisiert werden sollen. Da das Gericht damit von der Entscheidung des OLG Brandenburg aus dem Jahr 2003 abweichen will, muss nun der Bundesgerichtshof abschließend entscheiden. Zudem sieht das Gericht auch in Art. 5 Abs. 6 VO 1370/2007 keine Grundlage für einen Verzicht auf Wettbewerb. Damit besteht nunmehr erhebliche Rechtsunsicherheit, ob Direktvergaben im SPNV zulässig sind.
The Higher Regional Court of Düsseldorf has the opinion that direct procurements regarding regional rail transport are not valid. This is especially true for those, which shall be realised according to section 15 para. 2 General Railway Act. The Federal Court of Justice irrevocable has now to judge this case. Furthermore the Court does not accept Art. 5 para. 6 EU-Regulation of 23 October 2007 on public passenger transport services by rail and by road as a base for a waiver of competition. Due to this it exists a great legal uncertainty whether direct procurements regarding regional rail transport are valid or not.
