Inhouse-Vergabe im ÖPNV. Nach europäischem und nationalem Recht möglich.

Abstract

Während im europäischen Recht durch die Rechtsprechung des EuGH die Voraussetzungen der In-house-Vergabe immer deutlicher erarbeitet werden, findet sie im deutschen ÖPNV praktisch nicht statt. Hinderungsgrund ist die derzeitige Auslegung des gewerberechtlichen Personenbeförderungsrechts, welche für den Fall der Erteilung einer Liniengenehmigung der Genehmigungsbehörde Auswahlkriterien vorgibt. Diese Auslegung ist dahingehend zu ändern, dass die Möglichkeit einer In-house-Vergabe akzeptiert wird. difuWhile the conditions of the In-house-allocations are elaborated more conspiciously than ever in terms of dispensation of the European Court of Justice (EuGH), they quasi do not exist for the public transit systems (ÖPNV). This is because of the present interpretation of the commercial passenger transit regulations which provide the selection criteria to the appropriate authorising agency by issuing line licences. This interpretation has to be changed to the effect that the possibility of an In-house-allocation will be accepted. difu
