Abstract
Im Rahmen des Beitrags wird das anzuwendende Prüfverfahren nach Art. 87 ff des EG-Vertrages zum Nachweis der beihilferechtlichen Unbedenklichkeit von Zuschüssen zu ÖPNV-Leistungen erläutert und anhand des praktischen Beispiels des Regionalverkehrs Ruhr-Lippe GmbH vorgestellt. Dabei wird gezeigt, dass eine Prüfung der beihilferechtlichen Unbedenklichkeit sich nicht auf das zurzeit vorrangig diskutierte vierte EuGH-Kriterium konzentrieren muss, sondern auch durchaus andere unternehmensspezifische Rahmenbedingungen (zum Beispiel Erlössituation, Privatinvestortest) dazu führen können, dass gewährte Zuschüsse als beihilferechtlich unbedenklich einzustufen sind. difu
Even growing regions are not spared by financial consequences due to the shrinking German population and its ageing. Regional mobility becomes more expensive and the public transit (ÖPNV) will have to self-finance from the fare revenues. At the same time, the ageing intensifies the market situation. With the axis approach and the development of the city state, Hamburg has quite favourable public transit conditions as the ÖPNV means a location factor and creates public image and urbanity. But the target groups of the public transit may change their requirements. The customers' prospects and emotions will modify as well. How can the public transport systems be prepared for this strategic development? The answer would be the development from a traffic assiociation to a mobility association. difu
