Abstract
Die deutsche Unterscheidung zwischen eigen- und gemeinwirtschaftlichen Verkehren schließt eigenwirtschaftliche Verkehrsleistungen von der Geltung der VO (EWG) 1191/69 aus. Obwohl § 8 Abs. 4 PBefG eigenwirtschaftliche Verkehrsleistungen definiert als solche, deren Aufwendungen durch Unternehmenserträge im handelsrechtlichen Sinn (einschließlich öffentlicher Ausgleichsleistungen) gedeckt werden, grenzt die nationale Gesetzgebung den Gebrauch von Ausnahmeregelungen entsprechend Art. 1 Abs. 1 Unterabsatz 2 der VO eindeutig ab. Die Prüfung, ob Ausgleichsleistungen Beihilfecharakter haben, richtet sich seit dem Altmark-Urteil nach den Kriterien des Europäischen Gerichtshofes. difu
The German distinction between transports operated on a commercial basis and transports operated in the public interest excludes the commercially operated transport services from the scope of the regulation (EEC) No 1191/69. Although Paragraph 8 (4) of the PBefG defines commercially operated transport services as those whose costs are covered by income of the undertaking as defined in commercial law (including public compensation) the national legislation clearly delimits the use of the option of derogation provided for in the second subparagraph oft Article 1(1) oft the regulation. The reason is, that public compensations must only be treated as income of the undertaking defined in commercial law, if they escape the classification as State aid as decided by the Court of Justice in the Altmark-case. difu
