Legenden und Irrtümer. Plädoyer für eine grundlegende Reform des PBefG.

Abstract

Der Beitrag erläutert die sich aus der VO 1370/07 ergebenden Auswirkungen für das Personenbeförderungsgesetz. Es wird aufgezeigt, dass die rechtlichen Rahmenbedingungen des PBefG zur Organisation des ÖPNV mit striktem Genehmigungsvorbehalt sowie zwingender Übernahme von Beförderungs-, Betriebs- und Tarifpflichten nur im Rahmen der VO 1370/07 aufrecht erhalten werden können. Die Überlegungen zum so genannten kommerziellen Verkehr außerhalb der VO stehen demnach nicht im Einklang mit dem Europarecht. Es wir dringend davor gewarnt, das neue PBefG mit dieser Rechtsunsicherheit zu belasten.This article comments on the results referring to decree 1370/07 of the Passenger Transport Act. It is pointed out that the legal frame structure of the Passenger Transport Act which is to organize the local public transport can only be adhered to within the decree 1370/07 in compliance with a rigid authorisation reservation as well as a compulsory assumption of transport, operation and fee obligation. Hence, the considerations about the so called commercial transport beyond the decree are not consistent with the European Law. They strongly caution against straining the new Passenger Transport Act with this legal uncertainty.
