Abstract
In Deutschland gibt es eine weit verbreitete Praxis der so genannten marktorientierten Direktvergabe von ÖPNV-Verträgen. Nach dem aktuellen Stand des EG-Rechts scheint es allerdings, mit Ausnahme von In-House-Geschäfte, wenig Raum für die Direktvergabe von Buslinien zu geben. Nach dem Inkrafttreten der neuen europäischen ÖPNV-VO (EG) 1370/2007 am 3. Dezember 2009, wird ein wettbewerbliches Verfahren zwar noch immer die Regel sein, jedoch wird es erheblich mehr Möglichkeiten zu einer rechtskonformen Direktvergabe geben. difu
In Germany, there is a practice to award the public transport contracts on market-based conditions without any form of public tendering procedure. The current EC rules in the field of public procurement, however, do not leave much room for the direct award of public transport contracts with exception to in-house awards. After the entry into force of Regulation (EC) 1370/2007 on public passenger transport services by rail and by road on 3 December 2009, the award of public transport contracts is in principle still be subject to a public tendering procedure. The regulation foresees, more exception grounds to award in a lawful manner such contracts without any tendering procedure. difu
