In the Altmark judgement (dated 24 July 2003) passed in the law case C-280/00, the European Court of Justice has expressed doubt about the clarity of the German law in regard to its differentiation between the traffic results achieved in the area of private or public sector enterprise. The Federal Administrative Court has contributed to this uncertainty in its case submission by referring to an entrepreneur's right to choose either of these alternatives. Such a choice, however, does not exist. German law - and its preference for private sector enterprise traffic results - takes the legal security requirement fully into account. This report offers in detail the public sector subsidies which do not represent official financial assistance. If they did, they would be covered by regulation 1191/69 according to which official notification is not required. Retrospective application of the German VO (Highway Code) - covering § 13a PBefG - is not allowed. difu
