Abstract

Art. 3 Abs. 2 VO (EG) Nr. 1370/2007 ermöglicht die Gewährung von Ausgleichsleistungen für die Anwendung von Höchsttarifen auf der Grundlage allgemeiner Vorschriften. Allgemeine Vorschriften im Sinne der Verordnung können auch Verträge sein. Die Struktur der Verkehrsverbünde in Deutschland kann in der Regel mit begrenztem Aufwand an die Vorgaben der VO (EG) Nr. 1370/2007 angepasst werden. Entscheidend ist, sicherzustellen, dass keinem der beteiligten Verkehrsunternehmen Ausgleichsleistungen zukommen, die den negativen finanziellen Nettoeffekt im Sinne der Ziff. 2 des Anhangs der VO (EG) Nr. 1370/2007 übersteigen.
