Abstract

Die neue SektVO und die durch die Vergaberechtsreform 2009 überarbeiteten §§ 97 ff. GWB schaffen mit dem frei wählbaren Verhandlungsverfahren klare Bewerbungs- und Vergaberegelungen für die Beschaffung von Straßen-, Stadtbahnen und Busse durch Sektorenauftraggeber. Für den vorgeschalteten Teilnahmewettbewerb können zur Eignungsfeststellung der Bewerber so genannte Prüfungssysteme nach § 24 SektVO auch auftragsunabhängig und zur Nutzung durch Dritte eingerichtet werden.The new German SektVO and the redrafting of the §§ 97 ff. GWB as part of the reform of the public procurement law in 2009 introduced an arbitrary negotiation procedure that creates clear rules for the application and award of contracts for the procurement of light rail vehicles and busses by the contracting public utility companies. For the upstreamed competition to participate in these procurements, so called qualification systems according to § 24 SektVO may be established for eligibility tests for applicants. These tests can also be set up independently from the placing of orders and for the use of third parties.
