Art. 69 BayGO Vorläufige Haushaltsführung - von der Ausnahme zur Regel?

Abstract

Im Rahmen der Arbeit wird der Frage nachgegangen, ob die Fallkonstellation der vorläufigen Haushaltsführung - exemplarisch anhand des Art. 69 der Bayerischen Gemeindeordnung - auch für die Fallkonstellation der "haushaltslosen Zeit", insbesondere der mehrjährigen passt. Zunächst werden die Ursachenkomplexe für kommunale Haushaltsdefizite theoretisch anhand der Einnahme- und Ausgabestruktur von Kommunen herausgearbeitet, sodann anhand von Praxisbeispielen belegt. Es folgt eine Analyse der einzelnen Regelungsinhalte des Art. 69 BayGO in der Normalfallkonstellation der vorläufigen Haushaltsführung und der teilweise konterkarierenden Auswirkungen im Fall der Anwendung auf die haushaltslose Zeit und die konkrete Darstellung der rechtlichen Problematiken in der praktischen Anwendung des Art. 69 BayGO auf diese Konstellation. Erkennbar wird danach eine Regelungslücke für die haushaltslose Zeit, für die die in der Wissenschaft und Praxis diskutierten Lösungsansätze (u.a. Kommunale Insolvenz) dargestellt und einer kritischen Würdigung unterzogen werden. Zur Schließung der gesetzlichen Regelungslücke wird im Ergebnis eine eigenständige gesetzliche Regelung, die im Fall der Bayerischen Gemeindeordnung Art. 69 a GO heißen könnte, vorgeschlagen und formuliert.Within the scope of this work becomes to the question followed, whether the case constellation of the temporary housekeeping - exemplarily with the help of the article. 69 fits the Bavarian local order - also for the case constellation of the "time without household", in particular of the several years' ones. First the cause complexes become for municipal budget deficits theoretically with the help of the taking - and issue structure of local authority districts , occupied then on the basis of practise examples. There follows an analysis of the single regulation contents of the article. 69 BayGO in the normal case constellation of the temporary housekeeping and the partly going against effects in the case of the use to the time without household and the concrete representation of the juridical problems in the practical use of the article. 69 BayGO on this constellation. Recognizably a regulation gap becomes afterwards for the time without household, for in the science and practise to discussed solution attempts (among other things Municipal insolvency) are shown and are submitted to a critical acknowledgment. An independent legal regulation, becomes in the result closing the legal regulation gap in the case of the Bavarian local order article. 69 a GO could be called, suggested and formulated.
