Abstract
Die VO 1370/2007 verlangt, dass Betreiber öffentlicher Personenverkehrsdienste einen bestimmten Anteil der Verkehrsleistungen selbst erbringen. Manche sehen darin das Ende kommunaler Verkehrsmanagementgesellschaften. Der Beitrag tritt dem entgegen und zeigt, dass auch unter Geltung der VO 1370/2007 Verkehrsmanagementgesellschaften vor allem zur Nutzung des steuerlichen Querverbundes Liniengenehmigungen innehaben können, ohne die Verkehrsleistungen selbst durchführen zu müssen.
In Germany, public transport is often provided by publicly owned management companies which have completely outsourced the services to private subcontractors. Local authorities use this model for fiscal reasons mainly. Regulation (EC) No 1370/2007 requires that public service operators shall perform a major part of the public passenger transport services themselves. Prima facie, this seems to be incompatible with management companies. However, the article shows that local authorities can continue to make use of management companies and that there is no need to insource the services.
