Öffentlichkeitsbeteiligung bei der Lärmaktionsplanung - Modellprojekt "Mach's leiser" in Leipzig.

Abstract

Öffentlichkeitsbeteiligung ist ein wesentlicher Aspekt der modernen Lärmminderungsplanung. Dieser zielorientierte Ansatz ist in der EU-Umgebungslärmrichtlinie implementiert. Dementsprechend sind Bürger bereits bei der Erarbeitung von Lärmminderungsmaßnahmen und der Festsetzung ruhiger Gebiete angemessen zu beteiligen. Die zunehmende Forderung nach akustischer Lebensqualität lässt auch das juristische Interesse in den Vordergrund treten. So hat sich die Rechtsprechung insbesondere damit befasst, ob subjektive Rechte bei der Aufstellung eines Lärmaktionsplanes bestehen und welche Bindungswirkung durch diesen eintreten könnte. Um die Öffentlichkeitsbeteiligung zu stärken, hat das Umweltbundesamt zwei Projekte des "Ökolöwe - Umweltbund Leipzig e. V." gefördert. "Mach´s leiser - Mitwirken bei der Lärmaktionsplanung in Leipzig" ist ein Modellprojekt, das in mehreren Stadtteilen Leipzigs durchgeführt wurde und gezeigt hat, wie Öffentlichkeitsbeteiligung als effektives Instrument zum Schutz vor Umgebungslärm in Deutschland definiert und umgesetzt werden kann. Es kann somit als Vorbild für andere Kommunen dienen.Public participation is a key aspect of modern noise abatement planning. This goal-oriented approach is implemented in the European Environmental Noise Directive. Citizens are already involved by the developing of concrete proposals of noise reduction measures and the determination of quiet areas. Moreover, the growing demand for acoustic quality of life indicates a higher juridical interest. Therefore, the courts have to answer several questions in this context. For example, the subjective right in the arrangement a noise action plan and its binding effect for private companies. In order to strengthen public participation further, the German Environment Agency supports two projects of the environmental alliance "Ökolöwe e.V. "Do it quieter - Participation of noise action planning in Leipzig". These model projects demonstrate in several districts of Leipzig how public participation can be used as an effective instrument to protect the inhabitants against noise pollution. This model project may serve as an example in this respect.
